Compliance Alert – Ethanol Producers

The new Renewable Fuel Standard (RFS2) was finalized on February 3, 2010 under amendment to 40 CFR part 80. An exporter of renewable fuel must receive an EPA-issued identification number prior to engaging in any transaction involving Renewable Identification Numbers (RINs). Registration under the RFS program is required to be submitted and accepted by EPA prior to July 1, 2010 or 60 days prior to RIN ownership. Subpart 80.1450 (b) sets forth the information that must be provided and requires an independent third party engineer verify the information submitted as part of the registration.
